Senior Counsel-EH&S and Construction

The Senior Counsel for Environmental Health & Safety and Construction must demonstrate expertise in environmental compliance counseling and defense of enforcement actions in matters involving a broad range of issues, including water quality, air quality, hazardous materials transportation, hazardous waste disposal, medical waste handling and disposal, property remediation, and biological, chemical, and radiation safety in the workplace (CAA, CERCLA, CWA, EPCRA, ESA, OSHA, RCRA, TSCA, and analogous state laws). The Senior Counsel will advise UCOP, campus, and medical center EH&S directors and managers, as well as technical EH&S staff, on a wide variety of sensitive questions and will represent the University in interactions with permitting and enforcement agencies across California. Counsel will also provide environmental legal perspective on transactional matters, including real estate purchases, sales, and leases, and University development projects.

In addition to environmental compliance responsibilities, Counsel will advise on the University's broad portfolio of complex construction and development operations, including the following topics and tasks: drafting and negotiation of construction contracts; public sector construction litigation and public competitive bidding; mediation, arbitration, and/or trial (typically with outside counsel) to resolve construction defect or design disputes; Mechanic's Lien Law and its application to public and private construction projects; development of effective compliance and risk mitigation strategies to facilitate projects; and public-private partnerships.

Counsel will proactively and independently handle a full range of legal matters and projects, including the most complicated and those of substantial importance and impact. Counsel will interpret complex facts and the law in areas of high ambiguity; provide functional advice, training and/or guidance to others; act as a liaison with outside counsel; and/or represent the University in complex litigation.
