    This is a position in the Employment Law Group of the Corporation Law Department. Candidates must have a minimum of 4 years of employee benefits experience. Areas of responsibility will include, but are not limited to, providing legal advice regarding Section 125 plans, health and welfare plans, wellness programs, disability leave and benefits, and employee-benefits issues related to divestitures, mergers and acquisitions. 

    Responsibilities for this position may include but are not limited to:

    • Advise on ERISA, ACA, COBRA, HIPAA, and other healthcare laws and Internal Revenue Code requirements applicable to employer health and welfare plans.
    • Draft ERISA plan texts, summary plan descriptions and summaries of benefits and coverage
    • Review annual open enrollment materials and other benefit communications for legal compliance
    • Advise on various wellness programs and ensure legal compliance
    • Support Requests for Proposals (RFPs)
    • Negotiate vendor contracts
    • Train on Section 125, ERISA, HIPAA, fiduciary duty and other benefit legal requirements
    • Advise on employee benefits claims and appeals
    • Advise on benefits-related merger, acquisition, and divestiture issues
    • Advise on disability benefits, including knowledge of California Voluntary Disability Plans, FMLA, sick leave laws, etc.
    • Advise on requirements of State and local Paid Family Leave laws
    • Juris Doctorate or similar law degree. Must be admitted to practice law in some U.S. state or in the District of Columbia, and obtain eligibility to practice law in-house in California or Texas (depending on work location).
    • In-depth knowledge of ERISA, the Affordable Care Act, COBRA, HIPAA, etc. and applicable Internal Revenue Code provisions.
    • At least 4 years of experience as a benefits attorney.
    • Demonstrated skill and experience in providing timely and client-focused advice and counsel on benefit-related issues.
    • Demonstrated skill and experience in litigation risk assessment and risk avoidance/reduction strategies.
    • Demonstrated skill and experience in effectively communicating complex issues (oral and written).
    • Experience advising on private health care exchanges
    • Experience advising on executive compensation and retirement plans
    • Litigation experience
    • Relocation may be considered within Chevron parameters.
    • Expatriate assignments will not be considered
